Maybe, maybe not...IF you are subject to Part 15, then that's the case, but in general Spark Gap type TCs are not subject to Part 15, any more than, say, an arc welder. If you have any digital circuitry faster than 9kHz clock, though, then you're in Part 15 territory.
Granted, if the FCC comes knocking at your door, helping them out is a wise plan.
