Should not be, but that will really depend more on the actual average
current draw than name plate ratings. The actual average current will depend
on the tank cap and spark gap, the BPS etc. and may be less or more than the
nameplate.

Not on single phase. The only problem would be if the total current on that
side of the line gets too high and trips the main breaker.
What brand of panel/breakers do you have? Most brands have 40A single poles
available, but you will probably have to buy one from an electrical supply
house rather than the local hardware or home center.
